ChainList Terms of Service

1. Acceptance of Terms

By accessing or using ChainList ("ChainList," "we," "us," "our," or the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Site.

You represent that you are at least 18 years old and legally capable of entering into binding agreements.

2. Nature of the Service

ChainList is an online classifieds and community platform that enables users to post listings and communicate with other users.

ChainList:

• Does not verify users
• Does not endorse listings
• Does not guarantee transactions
• Is not a party to any transaction
• Does not act as an escrow agent
• Does not take custody of funds or digital assets
• Does not operate as a broker, dealer, exchange, marketplace operator, money transmitter, investment advisor, or financial intermediary

All transactions occur solely between users at their own risk.

3. Section 230 Notice (U.S. Law)

ChainList is an "interactive computer service" under 47 U.S.C. § 230. We are not the publisher or speaker of content provided by users. We are not responsible for user-generated content, including listings, messages, comments, or other materials.

4. Use at Your Own Risk

You acknowledge that:

• Listings may be inaccurate, fraudulent, misleading, or illegal
• Users may misrepresent identity, authority, or ownership
• Transactions may involve scams or fraud
• Cryptocurrency and digital asset transactions are irreversible and volatile

You assume full responsibility for all interactions and transactions.

5. Crypto & Digital Asset Disclaimer

ChainList may allow listings referencing cryptocurrency, NFTs, tokens, or blockchain-based assets.

ChainList:

• Does not validate ownership of digital assets
• Does not verify smart contracts
• Does not guarantee authenticity or transferability
• Does not monitor blockchain transactions
• Does not provide custody services

All crypto transactions are irreversible. Blockchain networks may fail, fork, or become congested. You assume all risks associated with digital asset use.

Nothing on the Site constitutes financial, investment, trading, or legal advice.

6. User Conduct

You agree not to:

• Post fraudulent, misleading, or deceptive content
• Facilitate scams, phishing, money laundering, or illegal activity
• Offer regulated securities without compliance
• Post infringing intellectual property
• Harass, threaten, or impersonate others
• Circumvent moderation systems
• Use bots or automated scraping tools without permission
• Attempt to exploit vulnerabilities

We reserve the right to remove content or suspend accounts at our sole discretion.

7. Prohibited Transactions

You may not use ChainList for:

• Illegal goods or services
• Controlled substances
• Weapons prohibited by law
• Human trafficking or exploitation
• Stolen property
• Unlicensed securities offerings
• Money transmission services
• Sanctioned individuals or jurisdictions

We reserve the right to cooperate with law enforcement.

8. Content Ownership & License

You retain ownership of content you post. By posting, you grant ChainList a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content in connection with operating the Site.

9. DMCA & Copyright Policy

If you believe your copyrighted material has been infringed, submit a notice containing:

• Identification of the copyrighted work
• Identification of the infringing material
• Your contact information
• A statement under penalty of perjury of good faith belief

We may remove allegedly infringing content and may terminate repeat infringers.

10. Disclaimer of Warranties

The Site is provided "as is" and "as available."

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

We do not guarantee uninterrupted, secure, or error-free operation.

11. Limitation of Liability

To the fullest extent permitted by law, ChainList and its affiliates shall not be liable for:

• User interactions or transactions
• Loss of funds, crypto, NFTs, or digital assets
• Indirect, incidental, consequential, punitive, or special damages
• Data loss or unauthorized access
• Service interruptions

Total aggregate liability shall not exceed the greater of:

• $100 USD
• The amount paid to ChainList in the previous 12 months

Some jurisdictions do not allow certain limitations; those limitations apply only to the extent permitted.

12. Indemnification

You agree to indemnify and hold harmless ChainList, its owners, officers, affiliates, and employees from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Site
• Your violation of these Terms
• Your violation of any third-party rights
• Any transaction you engage in

13. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason.

Sections relating to liability, indemnification, dispute resolution, and governing law survive termination.

14. Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

You waive the right to participate in class actions, class arbitrations, or representative proceedings.

Arbitration shall take place in the State of New Jersey. Either party may seek injunctive relief in court for intellectual property violations.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Exclusive venue for any non-arbitrable disputes shall be the state or federal courts located in New Jersey.

16. Privacy

Your use of the Site is subject to our Privacy Policy, incorporated herein by reference. We collect only the minimum data necessary to operate the platform. We do not sell your personal information. For concerns about your data, contact support@chainlist.buzz.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Assignment

We may assign these Terms in connection with a merger, acquisition, asset sale, or corporate restructuring.

We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, government actions, internet failures, or blockchain network disruptions.

20. Modifications

We may update these Terms at any time. Continued use after changes are posted constitutes acceptance.
